What Is Dram Shop Liability?
If you or a loved one has been hurt in a drunk driving accident, the drunk driver may not be the only party you file a claim against to recover for your injuries.
If the drunk driver was over-served by a drinking establishment, you may be able to pursue what’s known as a dram shop claim to recover from that business as well.
Decades Of Collective Experience To Help You Recover
At the law firm of Manzi, Seccareccio & Merwin, P.C., in Lowell, Massachusetts, our attorneys bring over 50 years of cumulative experience to claims against bars, nightclubs, restaurants and other drinking establishments in Dracut and across Massachusetts.
Often, these claims are handled side-by-side with the more traditional car accident claim. We know how to balance the claims for maximum effect.
Proving That The Drinking Establishment Is At Fault
In every OUI case, the police will ask the drunk driver where he or she was drinking. This information may come out at court in the criminal case as well. If there is reason to believe that a business served the drunk driver more than was reasonable and prudent, we will pursue a dram shop claim. Of course, the drinking establishment will not simply accept the blame. The owner or the bartender will simply claim that he or she was doing business as usual.
We know how to get the facts. We will find witnesses who can testify to the fact that the drunk driver was continually served alcohol even though he or she was clearly intoxicated. We will find receipts that show the number of drinks ordered. Furthermore, if there is evidence that a bartender knew that the intoxicated individual intended to drive, we will use that to strengthen our case. Our lawyers know how to get results.
